1. Acceptance of Terms
By accessing and using the Vakugan platform (hereinafter, "the Service"), operated by Yuri Ferreira Marques (also known as "Vakugan"), you agree to comply with and be bound by the following terms and conditions of use. If you do not agree with any part of these terms, you must not use the Service.
2. Service Description
Vakugan is an omnichannel messaging platform that allows users to manage business conversations across multiple communication channels (WhatsApp, Instagram, Telegram, Email, etc.) in one place, with artificial intelligence integration.
The Service includes conversation management features, AI-powered automation, integrations with third-party platforms, and analytics and reporting tools.
3. Eligibility
To use the Service, you must be at least 18 years of age and have the legal capacity to enter into binding contracts. By registering, you declare and warrant that you meet these requirements.
4. Wallet System and Billing
4.1. User Wallet
Each user has a wallet (virtual wallet) associated with their account. The use of the platform generates consumption that is automatically deducted from the available balance in your wallet according to the established rates for each operation or functionality used.
4.2. Billing Management
Billing, price updates, payment management, and other aspects related to the collection of the Service are managed through Polar.sh, a third-party service specialized in payment processing and billing.
4.3. Withdrawal of Funds
Funds deposited in the wallet are intended exclusively for the consumption of the Service. In principle, withdrawal of money from the wallet is not allowed. Fund withdrawal may only be carried out in exceptional, duly justified cases and after individual evaluation, such as demonstrated fraud, billing error, or similar circumstances requiring a justified refund.
4.4. Wallet Capacity
The use of the Service is limited only by the capacity of the available balance in your wallet. There are no additional usage limits beyond the resources available in your account.
5. Acceptable Use
5.1. Prohibitions
It is strictly prohibited to use the Service for:
- Sending unsolicited messages, spam, or unauthorized bulk communications
- Transmitting, storing, or distributing any content that is illegal, fraudulent, defamatory, harassing, abusive, obscene, or otherwise objectionable
- Violating intellectual property rights, trademarks, or privacy rights of third parties
- Attempting unauthorized access to systems, accounts, networks, or data that do not belong to you
- Engaging in activities that could damage, disable, overburden, or compromise the Service
- Any use that violates applicable laws or regulations
5.2. Legal Compliance
You are responsible for complying with all applicable laws and regulations related to the use of the Service, including but not limited to data protection laws, commercial communications, and specific regulations for each communication channel used.
6. User Accounts
6.1. Registration
To use the Service, you must register by providing accurate, current, and complete information. It is your responsibility to maintain and update this information.
6.2. Account Security
You are responsible for maintaining the confidentiality of your access credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
7. Intellectual Property
The Service, including its design, functionalities, source code, trademarks, and content, is the property of Yuri Ferreira Marques (Vakugan) and is protected by intellectual property laws. You do not have the right to copy, modify, distribute, or create derivative works from the Service without express authorization.
8. Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without prior notice. Service updates and modifications may be implemented automatically.
9. Limitation of Liability
To the maximum extent permitted by law, Yuri Ferreira Marques (Vakugan) shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use the Service, including loss of data, revenue, or profits.
10. Indemnification
You agree to indemnify, defend, and hold harmless Yuri Ferreira Marques (Vakugan) and its affiliates from any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.
11. Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you violate these Terms.
You may cancel your account at any time. Upon cancellation, your access to the Service will cease, but those provisions that by their nature should survive will remain in effect.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Spain. Any dispute related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Spain.
13. Data Protection
The processing of your personal data is governed by our Privacy Policy, which complies with the General Data Protection Regulation (GDPR) of the European Union. By using the Service, you agree to the processing of your data as described in that policy.
14. Modifications to the Terms
We reserve the right to modify these Terms at any time. Modifications will take effect when published on this page. It is recommended to review these Terms periodically. Continued use of the Service after modifications constitutes your acceptance of the new terms.
